Milestones

  • This Grow With Me Sessions Agreement (the “Agreement”) is by and between the above named client (the “Client”) and Yellow Creek Photography, LLC (the “Photographer”). This session costs $900 newborn, 3 months, 6 months, 9 months, and 12 months sessions. Newborn session is in studio for up to 3 hours and includes 20 images. The 3, 6, and 9-months sessions are in studio and are 45 min. in length and include 20 edited images. Twelve months is at an agreed upon location within 5 mile radius of Monroe, IN and is one hour in length and includes 20 images. Each session’s images will be on a gallery and will include a print release. A $250 non-refundable deposit is required and a $250 payment is required at newborn. A $200 payment is require at 3 month and 6 month sessions. There is no charge for 9 month or 12 month sessions. Images are delivered via digital download with print release for personal printing purposes.

    The Client agrees to pay a $250.00 non-refundable deposit at the time the date for the newborn photo session is reserved. The remaining balance of $650.00 will be paid during the next three sessions: $250 at newborn: $200 for 3-month, and 6-month sessions. Each installment will be paid on or before the session date.

    The Photographer will create a private password protected online gallery for each session consisting of 20 images for each session. The online galleries will be available within 21 days of each session for the Client to review, show to family and friends and for the ordering of prints. The images in each session gallery will be available for 30 days. If, after that time, the Client wishes to have the online gallery posted again a $50.00 re-archival fee applies and must be paid prior to reposting the gallery.

    In the event of adverse weather conditions on the day of the session, the Photographer may reschedule to another day. The photographer reserves the right to reschedule the session should weather conditions not fit the Photographer’s artistic vision for the session.

    Please notify the Photographer at least 48 hours prior to the photo session if you must reschedule. In the event the Client fails to show for a scheduled session without 48 hours notice, the Photographer may, at her discretion, cancel the session and retain the Session Fee or reschedule the session.

    Although extreme care will be taken with the images and photographs taken during the session, any and all liability for loss, damage or failure to deliver pictures for any reason shall be limited to return of the Session Fee.

    The Photographer retains the copyright and ownership of all images of the photo session and reserves the right to reproduce or sell the images for any reason including, but not limited to: portfolio, studio display, gallery display, website, self-promotion, and photo contests.

    Images shall only be used with the written consent of the Photographer. Any image used on the internet for any reason by the Client including, but not limited to blogs, websites, Facebook, twitter, instagram, google+, or any other internet sites either now or existing in the future shall mention Yellow Creek Photography.

    In the event either party shall breach this agreement, the parties hereby agree that any action shall be subject to the laws of the State of Indiana and shall be brought in the County of Adams. Photographer shall have the right to attorney’s fees and costs should Photographer prevail on any action under this Agreement.

    By digitally signing this Grow With Me Basic Portrait Sessions Agreement, the Client is certifying that he/she has had an opportunity to review the Agreement and understands and agrees to the terms and conditions contained herein.

    For valuable consideration received, I hereby grant to Yellow Creek Photography, LLC the absolute and irrevocable right and unrestricted permission in respect of photographic portraits or pictures that she takes of me and my family or in which I/we may be included with others, to copyrights the same, in her own name or otherwise; to use, re-use, publish, and re-publish the same in whole or in part, individually or in any and all media now or hereafter known, and for any purpose whatsoever, for illustration, promotion art, editorials, advertising, and trade, or any other purpose whatsoever without restriction as to alteration; and to use my name in connection therewith is she so chooses.

    I hereby release and discharge Yellow Creek Photography, LLC from any and all claims and demands arising out of or in connection with the use of the photographs, including without limitation any and all claims for libel or invasion or privacy. I hereby waive any right that I or the minor may have to inspect or approve the finished product or products or the advertising copy or printed matter that may be used in connection therewith or the use which it may be applies.

    This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom she too the photographs. I am of full age and have the right to contract in my own name. I have read the foregoing and fully understand the contents thereof. This release shall be binding upon me and my heirs, legal representatives, and assigns.

  • **I agree to the terms set forth in this Portrait Agreement.**
